2.2.3 - OTIUM INTERNATIONAL will not be liable and it will not provide compensation for the missing of arrival or departures transfers in those cases where the clients HAVE OMITTED OR HAVE NOT PRESENTED IN THE CORRECT FORM, the date of the service, the flight number and the time of arriving or departing, the lack of one or more of the categories above exempts OTIUM INTERNATIONAL of any liability. If the destination the client informed does not match partly, or totally, with the place of his, her accommodation at the time of being service, the client will be absolutely responsible for the payment of the extraordinary expenses that maybe incurred.
2.2.4 - SPECIAL REQUESTS: OTIUM INTERNATIONAL will not spare efforts to accomplish with any application or special request that the client may make; although to have requested it DOES NOT IMPLIES CONFIRMATION, the acceptance of a service or special request by OTIUM INTERNATIONAL will be expressly and only confirmed ( in addition to confirmation provided by the system) through e-mail, while there is no confirmation email, it will be understood that the special request made HAS NOT BEEN CONFIRMED AS YET. OTIUM INTERNATIONAL does not accept any bookings that may be conditional to the completion of special requests. In case of doubts on your requests consult us to email@example.com.
2.2.5 - All the information clients should provide during the booking process remains full and exclusive responsibility of the client. OTIUM INTERNATIONAL will not be involved in any of the stages of this process.
In case the client notices (by any means) that a booking has been duplicated, he/she should immediately contact OTIUM INTERNATIONAL client’s service office.
OTIUM INTERNATIONAL will not be liable by reason or consequence of a duplicated booking.
3 - Baggage (conditions for the arrival/departure transfers): The authorized and included baggage is a suitcase of not more than 25 kg which dimensions do not exceed a length maximum + width + height of 158cm and also a handbag.
3.1 - All clients must notify at least 72hrs before their trip on any additional article to the authorized baggage. In case the client fails to inform on time, OTIUM INTERNATIONAL shall have the right to charge the client in the destination by article or to cancel the service without rights be refunded on the part of the client.
Articles considered additional are the following:
* Extra baggage;
* Surfing boards;
* Golf equipment;
* Other non-declared articles.
3.2 - Clients with declared excess baggage, consisting of surfing boards, bicycles, folding wheelchairs, scooters or any larger size baggage will only be admitted in private transfers. The client will be charged in destination in case the service booked was not a private one and required to be turned private due to the the quantity or quality of your baggage.
3.3 - Golf clubs will always be considered as additional to the baggage and they should be declared at the booking time.
3. 4 - OTIUM INTERNATIONAL will not be responsible for the transport of non-declared large size baggage as: surfing boards, wheelchairs, Golf clubs, scooters, bicycles, etc.
3.5 - In the event that the client carries non-declared large size or excess baggage, they will be liable to pay additional charges necessary for the transfer of them.
3.6 - The clients’ baggage and their personal belongings are transported under their own risk and OTIUM INTERNATIONAL DOES NOT ACCEPT any liability for losses or damages.
NOTICE: with reference to the number of additional baggage the client carries, a private vehicle will be provided subject to direct payment by the passenger in destination.
4 - Payment is required at the time of booking. All the information provided should be accurate. Credit cards payments shall be made by the card holder. We reserve the right to charge your credit card before performing the transfers. OTIUM INTERNATIONAL will send a confirmation e-mail with the details of your booking. This payment is definitely nonrefundable, except in the events that OTIUM INTERNATIONAL has committed to cancel the reservation.
4.1 – We shall not sell or rent your personal information to any third party. OTIUM INTERNATIONAL will only share your personal information with authorized service providers who will access your contact details to notify you of any change or problem with regard to your reservation.
4.2 - Provided that our payment gateway only accepts USD; on the web page of your issuing bank the amount to be paid will be shown in USD using the exchange rate of the day computed by the relevant Bank. Some banks may apply a fee for the operation.
4.3 - All cash clients give drivers is considered to be gratifications or tips. OTIUM INTERNATIONAL will not take any responsibility for this; unless it has been previously agreed in writing otherwise.
5 - It is a commitment of OTIUM INTERNATIONAL that any of the transfers you buy from our web site are carried out following the best practices of transportation of the international tourist service level, and pursuant the agreement signed, the information provided is pertinent and shall not be subject to interpretation. OTIUM INTERNATIONAL reserves the right to subcontract any third parties and in such frameworks its responsibility is limited to insure the due care and soundness in the selection of the third party that will carry out the transfers instead.
5.1 - Otium International is a fully insured company under the law of the country. All due transfers are also insured by the operator.
5.2 - All vehicles have insurance for passengers inside the vehicle. OTIUM INTERNATIONAL does not take responsibility for damages or losses that have not direct bearing on our services.
5.3 - It is a condition for the reservation with OTIUM INTERNATIONAL that every client travels with the appropriate insurance cover.
6 – Rates shown on the website page will change with regard to: Type of service, agreed origin and destination, number of passengers, date and time of travel. OTIUM INTERNATIONAL reserves the right to modify rates at any moment and without previous advice note, without this incurring in damage for the reservations that were confirmed before.
6.1 - OTIUM INTERNATIONAL reserves the right to cancel bookings if it is considered that the existing conditions might risk the passengers’ safety. The cancellation communication will always come to the client by means of an e-mail message in advance to the date of the service. OTIUM INTERNATIONAL commits to fully refund the cancelled service.
7 - The indicated rates are by vehicles.
8 - Cancellations: The clients have the right to cancel the service booked by notifying Otium through e-mail. See the cancellation Policy.
9 – Cancellation Policy: In the event of cancellations made in a period under 7 days before due date: 100% discount, 0% refund is applicable.
9.1- In the event of cancellations made in a period between 8 and 14 days before due date: 30% refund is applicable
9.2- In the event of cancellations made in a period of 15 days or more before due date: 100% refund with 5% deduct of cancellation expense.
9.3 - Refunds will be made in USD. OTIUM INTERNATIONAL will not be responsible for bank expenses involved in the reimbursement, in all cases the above mentioned expenses will be a client’s responsibility.
10 - The booking confirmation our system issues and reaches our clients through e-mail is deemed as a receipt or voucher of service. The client must show this voucher to the bus driver or OTIUM INTERNATIONAL representative both for the transfer of arrival and for the departure one. All the clients must observe the arrival / departures instructions.
11 - Children policy: The children and infants count for the occupation of the vehicle, regardless their age, and therefore they must be included in the total number of passengers when booking. If you need a child safe seat OTIUM INTERNATIONAL can provide it with an additional cost.
12 - Transport service:
12.1 – A REGULAR transfer service is provide when the vehicle is shared with other clients, and therefore the client may have to wait for certain time according to the amount of passengers and the number of stops during the travel.
12.2 - The booking rate covers the transfers from the airport up to the Hotel and backwards, as indicated in the confirmation voucher. Detours are not accepted in the route towards or from the hotel.
12.3 - OTIUM INTERNATIONAL reserves the right to refuse to transport any client supposed to be under the influence of alcohol, drugs or whose behavior is considered to be dangerous for the driver, the vehicle, or the safety of the other clients. Clients must be appropriately dressed for the travel.
12.4 - It is forbidden to drink alcoholic beverages while in our vehicles.
12.5 - It forbidden to smoke while in our vehicles.
13 - It is a client’s responsibility to carry with their booking confirmation voucher while they travel. It contains instructions and all local contact telephone numbers and opening hours in case of emergency. This booking confirmation voucher is proof that the service has been acquired with OTIUM INTERNATIONAL and we request all clients to print it, to read it and carry it during their holidays or business trip.
The client must show the booking confirmation voucher to OTIUM driver or representative. OTIUM INTERNATIONAL accepts neither any responsibility nor compensation claim for non-provision of service by clients who do not carry their booking confirmation voucher while they are travelling.
13.1 Upon arrival at airport, is the sole responsibility of the customer to move to the terminal and counter identified in the confirmation, where the client will receive by an OTIUM INTERNATIONAL staff and escorted to the vehicle assigned for the provision of the service. The maximum tolerance time or standby is one (1) hour counted from the moment the plane lands on the runway of the airport. After this time, the customer loses the right to services, without liability by OTIUM INTERNATIONAL (its subsidiaries, affiliates, parent, etc.), and without compensation or reimbursement to customer.
14 - Instructions for departure transfers:
The collection schedules that appear in the booking confirmation are estimated. IT IS COMPULSORY AND EXTREMELY IMPORTANT THAT THE CLIENT turns up before OTIUM INTERNATIONAL representative within 24hrs after checking in to the hotel. The representative will provide the client with general information on the destination and shall confirm the client’s flight information for departure. OTIUM INTERNATIONAL is not liable for those clients who do not confirm their picking-up ahead of time before departure by exposing to situations that may lead from the missing of the transfer or their returning flight. For departure transfer top waiting time span is 5 minutes in our vehicles.
14.1 - OTIUM INTERNATIONAL will reasonable endeavor to reassure that our vehicles are on due time at the collection points; nevertheless, circumstances out of our control can delay our vehicles. The following situations are examples of these circumstances:
a) Street or road accidents
b) Adverse weather conditions
c) Vandalism and terrorism
d) Unforeseen traffic jams
e) Delays caused by other clients
f) Vehicle arrested or delayed by a police officer
g) Unexpected mechanical problems
h) Force majeure and unforeseeable circumstances
14.2 At departure from the hotel to the airport, is the sole responsibility of the customer to move to the place in the hotel designated by OTIUM INTERNATIONAL, where the vehicle will be located to provide the services. The tolerance time or maximum waiting time is five (5) minutes counted from time scheduled . After the period of five (5) minutes, the customer loses the right of the service, without liability by OTIUM INTERNATIONAL (its subsidiaries, affiliates, parent, etc.), and without compensation or reimbursement.
